In these Terms, "Orbispect", "we", "us" and "our" mean ORBISPECT P.S.A. "You" means the person or entity accessing our website or services.
These Terms govern your use of the website at orbispect.com and, unless a separate signed agreement applies, our reports and APIs.
§2. The service.
Orbispect provides Earth-observation and satellite-data analytics, delivered as intelligence reports and as application programming interfaces (APIs).
Outputs are analytical estimates derived from remote-sensing data and models.
Specific scope, deliverables, service levels and pricing for paid engagements are defined in a separate order form or agreement, which prevails over these Terms in case of conflict.
§3. Acceptable use.
You agree to use the website and services only for lawful purposes.
You must not access or use them in breach of any applicable law, sanction or third-party right.
You must not attempt to gain unauthorised access to, interfere with, or disrupt the website, APIs or supporting infrastructure.
You must not circumvent rate limits, authentication or other technical or usage controls.
You must not scrape, harvest or bulk-extract content except through interfaces we provide for that purpose.
You must not resell, sublicense or redistribute the outputs except as expressly permitted in a written agreement.
§4. Intellectual property.
The website, the reports, the analytical outputs delivered through the APIs, and all related models, methods, software, text and design are and remain the intellectual property of Orbispect or its licensors.
Subject to payment and to any applicable agreement, you receive a limited, non-exclusive, non-transferable licence to use the deliverables for your internal business purposes. No rights are granted by implication.
Any underlying source data remains subject to the rights of its respective owners.
§5. Disclaimers.
Our outputs are analytical estimates produced from remote-sensing data and statistical models, and they carry inherent uncertainty. Where we state a figure, we aim to state its uncertainty alongside it.
Outputs are not guarantees, warranties or assurances of any particular condition, result or future outcome.
Outputs do not constitute financial, investment, legal, insurance, agronomic or other professional advice.
Outputs should not be relied upon as the sole basis for any decision with material consequences.
To the extent permitted by law, the website and services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
§6. Limitation of liability.
To the fullest extent permitted by applicable law, Orbispect shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, or business opportunity, arising out of or in connection with your use of the website or services.
Our total aggregate liability arising out of or relating to the services shall not exceed the amounts paid by you to Orbispect for the relevant service in the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
§7. Governing law and disputes.
These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law rules.
The courts competent for the registered seat of Orbispect shall have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have under the law of your place of residence.
§8. Changes to these terms.
We may update these Terms from time to time. The current version is always published on this page with the date of the last update shown above.
Continued use of the website or services after an update constitutes acceptance of the revised Terms.
